1. Introduction
wellclicks® ("wellclicks", "us" or "we") is committed to respecting the privacy rights of our customers, visitors, and other users of the wellclicks website currently located at www.wellclicks.com ("Website"). This Website Privacy & Security Policy ("Privacy Policy") serves to help you understand the measures we are taking to protect your privacy and personal information while navigating the Website. This Privacy Policy demonstrates our commitment to fair information practices with an aim to meet or exceed the best practices demonstrated on the web. This Privacy Policy is only applicable to the Website, and not to any other websites that you may be able to access from the Website, each of which may have data collection, storage, and use practices and policies that differ materially from this Privacy Policy. We are not responsible for the content and practices of any websites outside of wellclicks.com, which includes provider, insurance, health information, partners and any other websites.
2. Log Files and Traffic Data
Any time you visit the Website, our servers automatically track and collect information from your web browser. This information includes 1) your IP address, 2) browser type, 3) Internet service provider (ISP), 4) referring/exit pages, 5) operating system type and version, 6) a date/time stamp, 7) estimated geographic location, and 8) other information associated with the interaction of your browser and the Website (collectively "Traffic Data"). This information is stored into Log Files that reside on our web servers for no more than one (1) week. After one week, our Log Files are removed and archived. We use this archived information to help us analyze trends, administer the web site, prevent fraud, prevent and respond to other security concerns, track visitor movement in aggregate, and gather broad demographic information. We do not share the Log Files externally.
3. Personally Identifiable Information
In order for you to access certain areas of the Website, we may require you to provide us with certain information that personally identifies you, also known as personally identifiable information ("Personal Information"). Personal Information includes the following categories of information: (1) Contact Data (such as your email address, phone number and physical address); (2) Demographic Data (such as your gender, your date of birth and your zip code used for calculating a geographic location); (3) Insurance Data (such as your insurance carrier and insurance plan); (4) Personal Preference Data (such as search filters used during the Refine Matches process); (5) Medical Data (such as your previous health and wellness providers ("Providers" or individual "Provider") visited, your reason for visit, your date of visit, and other medical information you choose to share with us); and (6) Registration Data (such as your first name, last name, wellclicks password and appointment registration information requested by Providers).
4. Providers
All Providers featured on the Website have entered into the wellclicks Provider Agreement ("Provider Agreement"). Only providers agreeing to the terms of the Provider Agreement can use the tools provided on the Website.
5. Profiles
The Website features profiles that aid in the Matching process. We feature four types of profiles: 1) Provider, 2) Service, 3) Location, and 4) Organization. The information contained within these profiles (such as photographs, logos, other multimedia, descriptive text, credentials, accessibility information, basic demographics, and contact information), although stored on wellclicks servers and displayed on the wellclicks Website, is uploaded to the Website, owned, and managed by the Provider and/or the Provider's organization. The Provider assumes primary responsibility for this information as defined in the Provider Agreement. wellclicks reserves the right to remove any profile information from the Website at any time.
6. Appointments
The Website offers many interactive tools to help visitors contact and schedule appointments with a wide range of Providers. During the appointment scheduling process, wellclicks collects and stores Personal Information from our visitors and uses this information for the following purposes: 1) registering the visitor as a wellclicks user; and 2) registering the visitor for an appointment with the requested Provider. Information collected in both categories is stored and secured on our web servers. Information collected in category 1 is required to uniquely identify the user for all appointments scheduled on the Website and includes a first name, last name, date of birth, email address (user ID), and password. Information collected in category 2 (all other information not defined in category 1) varies among services and appointments. This information is uniquely configured by the Provider of the requested service for the registration of the requested service. All information collected during the appointment scheduling and registration process is shared with the requested Provider with the exception of your password.
7. Emails
We may use your Contact Data to send you information via email about wellclicks or our products or services, to contact you when necessary, including to confirm and remind you of appointments scheduled on the Website. To protect your personal privacy, detailed information about your appointment is only accessible by visiting the Website and logging in securely.
8. Cookies
We use "cookies" to keep track of some types of information while you are visiting the Website or using our services. Cookies are very small text-based files placed on your computer. They help us distinguish between repeat and new visitors and identify repeat visitors when they return to the Website. They also allow us to save user preferences and track user trends in conjunction with Traffic Data. We rely on cookies for the proper operation of our website; therefore, if your browser is set to reject all cookies, the website will not function properly. Users who refuse cookies assume all responsibility for any resulting loss of functionality. We do not link the cookies to any Personal Information and we do not use cookies to store login information such as passwords and session information.
9. Credit Card Information
To process credit card information for completing an electronic purchase on our Website, we may require your name, address, phone number, email address and credit card information (including card number, expiration date, and verification code). Such information is used to process your order or as otherwise described within this Privacy Policy. Credit card transactions are sent via Secure Socket Layers (SSL) encryption technology to a third party credit card processing server (Payment Gateway). wellclicks has partnered with Authorize.net for processing our credit card transactions and we follow their security guidelines for each transaction. 10. Storage, Modification and Removal of Personal Information
All data/information collected by the Website is stored indefinitely either on or off of our web servers. We store Personal Information until you request that we modify or delete the information. In some cases, we may retain Personal Information even after a request to modify or delete information from our servers/databases. Upon your request, wellclicks will use commercially reasonable efforts to modify or delete your account and the Personal Information in your profile; however, it may be impossible to remove your account without some residual information being retained by wellclicks. This residual information may be required to operate the Website. Any specific concerns about the storage of this information should be directed to privacy@wellclicks.com.
11. Children/Minors
Because of the nature of the transactions and actions being completed on the Website, wellclicks requires that all users of the Website be at least 18 years of age. Nevertheless, we understand that users under the age of 18 will be able to access our Website through public means. The Children's Online Privacy Protection Act (COPPA) severely restricts what information can be collected from children under the age of 13. For this reason, children under the age of 13 in the United States are prohibited from using the Website. The Website is not directed at children, and wellclicks does not knowingly collect any information from individuals under the age of 13. If we learn that we have received any information from an individual under the age of 13, we will use that information only to respond directly to that child (or a parent or guardian) to inform him or her that he or she cannot use the Website and subsequently we will delete that information from our servers.
12. Sharing of Information
We share certain categories of information we collect from you in the ways described in this Privacy Policy. We may share Demographic Data with advertisers and other third parties only on an aggregate (i.e., non-personally-identifiable) basis. We may also share your Contact Data, Demographic Data, Insurance Data, Personal Preference Data, Medical Data, and Registration Data with Providers you choose to schedule with on our Website. We also share Personal Information and Traffic Data with our business partners who assist us by performing core services (such as hosting, billing, fulfillment, or data storage and security) related to our operation of the Website and/or by making all of the Website's features available to our visitors and users. They may only use your Contact Data and other Personal Information to carry out their specific business obligations to wellclicks and to provide your requested health and wellness services. Last, we may transfer information about you to another company in connection with a merger, sale or acquisition by or of wellclicks. In this event, we will use reasonable efforts to notify you before information about you is transferred and becomes subject to a different privacy policy. wellclicks does not share, sell, rent or trade your Personal Information with any third parties for their promotional purposes.
13. User Choice
You may choose not to provide us with any Personal Information. In such an event, you can still access and use much of the Website; however, you will not be able to access and use those portions of the Website that require your Personal Information.
14. Confidentiality of Information
Except as otherwise provided in this Privacy Policy, we will keep your Personal Information private and will not share it with third parties, unless we believe in good faith that disclosure of your Personal Information or any other information we collect about you is necessary to: (1) comply with a court order or other legal process; (2) protect the rights, property or safety of wellclicks or another party; (3) enforce our Terms of Use; or (4) respond to claims that any posting or other content violates the rights of third-parties.
15. HIPAA
wellclicks is committed to safeguarding Personal Information, which may include information containing Protected Health Information ("PHI"). Access to PHI is provided on a need-to-know basis only and any breach may result in disciplinary action up to and including termination and legal action. wellclicks is not considered a covered entity under HIPAA ; however, wellclicks may be required to comply with certain provisions of HIPAA if it has entered into a business associate agreement ("BAA") with a covered entity (i.e. Providers). The terms of the BAA will specify the HIPAA obligations wellclicks has agreed to comply with on behalf of the covered entity. 16. Public Information
Any information that you may reveal in a customer review posting or other online discussion (i.e. messages boards or forums) is intentionally open to the public and is not private. What you have written may be seen and/or collected by third parties and may be used by others in ways we are unable to control or predict.
17. Use for Research
By using our Website, you agree to allow us to anonymously use the information from you and your experiences to aid our research into health and wellness matchmaking. We may publish this information publicly to share our successes in matching Providers with consumers. No Personal Information will be shared or made available in any published research.
18. Security Measures and Precautions
The security of your Personal Information is important to us. We have extensive security measures in place to protect the loss, misuse and alteration of the information stored in our databases. When you enter sensitive information on our Website, we encrypt that information using secure socket layer technology (SSL). Certain Personal Information stored on our databases is encrypted adding an extra layer of security. We have also employed proprietary security measures for uniquely identifying users and user sessions. We will exercise reasonable care in providing secure transmission of information between your computer and our servers, but given that no information transmitted over the Internet can be guaranteed 100% secure, we cannot ensure or warrant the security of any information transmitted to us over the Internet and hence accept no liability for any unintentional disclosure.
19. Lost or Stolen Information
If we become aware that your Personal Information has been disclosed in a manner not in accordance with this Privacy Policy, we will use reasonable efforts to notify you of the nature and extent of the disclosure (to the extent we know that information) as soon as reasonably possible and as permitted by law.
